Product Warranties & Returns
Savior Computing, Inc. warrants its workmanship on all maintenance services for a period of thirty (30) days from the date such services are rendered and shall repair or replace defective parts or materials during such thirty (30) day period without additional charge to Customer. Defective products must be returned in their complete packing. This includes cartons, manuals, cables, etc. If any of these materials are missing, or damaged, no credit or replacement can be issued. Any merchandise returned will be subject to a 15% restocking fee. No credit will be issued after 90 days. Software found to be defective must be returned to the manufacturer by the Customer. Savior Computing, Inc. will not be responsible for damaged or misused products.
Location of Sale
Savior Computing, Inc. is based in Buffalo, New York. For all legal purposes this shall be considered the place of sale. With each purchase, you agree to be bound by laws of New York State and accept the jurisdiction of this location in connection with any disputes or matters involving Savior Computing, Inc..
Price and Policy Changes
Prices and policies are subject to change without notice. Furthermore, Savior Computing, Inc. reserves the right to change, supplement or replace these terms and conditions at any time, in its absolute discretion. We are also not responsible for typographical errors.
Limitations of Liability
Customer hereby assumes all risk of loss of data from any and all causes or in any way related to or resulting from the sales, repair or service of products by Savior Computing, Inc.. Customer hereby releases Savior Computing, Inc. from any claim or liability related to any loss of data. We shall not be liable for loss or damage of any kind resulting from delay or inability to deliver on account of fire, labor troubles, accident, acts of civil or military authorities, shortages of raw materials, government regulations, or from any other cause beyond our control. Savior Computing will not be responsible for items left over 30 days from the date of service request. Service requests are performed on a first-come, first-serve basis. Products returned to us as defective will be evaluated by our technicians. There will be a charge for testing products in good working order. Be sure you understand the status of any warranties your product(s) may have as well as the charges for out of warranty work. You agree to, and accept, each and every one of the terms and conditions each time you place an order with Savior Computing, Inc..
Limitation of Remedies
Savior Computing, Inc.’s entire liability, and Customer’s exclusive remedy, for damages from any cause whatsoever, whether caused by an act, omission or negligence of Savior Computing, Inc., or any employee, representative, agent, or contractor of Savior Computing, Inc., and regardless of the form or action, shall be limited to amounts actually paid by Customer for repairs or services hereunder. In no event will Savior Computing, Inc. be liable for damage caused by Customer’s acts, omissions or negligence, or for special, incidental, or consequential damages, lost profits, personal injury to any individual, property damage, loss of use of equipment, loss of stored memory or data loss, cost of substitute equipment or other of such damages or costs, or for any claim against Customer by any third party. CUSTOMER SHALL BE SOLELY RESPONSIBLE FOR ANY DATA OR INFORMATION STORED IN, OR ON, ANY EQUIPMENT AND SHALL BE SOLELY RESPONSIBLE FOR MAKING “BACK-UP” OR SECURITY COPIES OF SUCH DATA OR INFORMATION. |
